PARTICULAR ASPECTS OF BIOTECHNOLOGICAL INVENTIONS AND THEIR PATENTABILITY
Abstract
Legal protection of intellectual property is an integral part of research and development (R&D) industry. Well-done management in the field of intellectual property can bring additional funds to R&D institutions. Biotechnological R&D, what relates with biological, chemical, and biochemical methods applied on organic or even biological material, is one of the fastest booming area of R&D at all. The paper presents juridical research in the area of biotechnological invention patentability, incl. relationship between invention and discovery in case of biotechnological patent law, with a special attention on inventions having context with embryo, DNA sequence. Both European and US patent laws are taken into account.
