THE LEGAL REGULATION OF TELEVISION AND RADIO BROADCASTING CONTENT AND THE CONTROL OF ADMINISTRATIVE BODIES WITH THE PARTICULAR REFERENCE TO THE PROTECTION OF JUVENILES
Abstract
The purpose of the paper is to point at the chosen problems which must be dealt with by the society when regulating the acceptance of information in connection with the protection of humanity and human dignity, mainly with the emphasis on the harmonic development of juveniles. Topic of the paper, which is anchored in the area of administrative law , offers the distinctive overlaps to the area of constitutional or family law and directs to multidisciplinary or international law research of the issue, concept and legal regulation, which remains (not only) in Slovak legal environment unfinished to the large extent even after years of scholarly and lay discussions. The basic political law guaranteed in the Constitution of Slovak Republic is the freedom of speech and the right to information, without which the existence of the real democratic system can not be possible. Democracy and its basic principles, expressed in the Constitution and in the laws of every democratic state creates from the point of view of the theory of law the legal institution. In spite of the right to information guaranteed by the Constitution, the protection of the juvenile spectator against the inadequate influence of the television and radio broadcasting should represent the main aim of the legal regulation in this area of law. The main legal enactments are except of the Constitution of Slovak Republic, Act no. 308/2000 of the Journal of Laws about broadcasting and retransmission and about the change of the Act no. 195/2000 of the Journal of Laws about the telecomunications, Act no. 167/2008 of the Journal of Laws about the periodical press and the agency press, the change and complement of various acts (press act). The aim of the paper, that is from the point of view of systematics divided into three parts except of introduction and conclusion, is to point at the chosen problems, that the slovak society must deal with when regulating the acceptance of information in connection with the protection of humanity and the human dignity with the emphasis on the harmonic development of juveniles.
